In exercise of the chief executive’s (head of paid service) specific delegation 4.3 in the constitution of South Oxfordshire District Council and Vale of White Horse District Council published on 11 October 2019 “To take any action considered necessary in an emergency.” (in consultation with group leaders), I authorise the council’s head of housing and environment to take such action as is necessary to enforce any requirement imposed by regulation 4 or regulation 5 of The Health Protection (Coronavirus, Restrictions) (England) Regulations 2020, including, but not limited to, issuing and serving prohibition notices and fixed penalty notices, taking legal proceedings for any offence, including for failure to comply, without reasonable excuse, with a prohibition notice and to authorise other officers to exercise any of these powers.

 

The scope of this authorisation shall also apply and extend to authorising such action as might be necessary in pursuance of any other provision (whether by statute, regulation or direction) by which the said 2020 Regulations may be replaced, amended or supplemented, and in respect of which the council may have a responsibility for enforcement.

 

This delegation shall remain in place from the date of this decision until 6 May 2021 or until the constitution is amended to include such a delegation, whichever is the earlier.
